{"id":1778,"date":"2018-02-03T16:31:14","date_gmt":"2018-02-03T16:31:14","guid":{"rendered":"http:\/\/www.pauljjhansen.com\/?p=1778"},"modified":"2018-02-03T16:31:14","modified_gmt":"2018-02-03T16:31:14","slug":"even-ca-state-employees-need-not-have-a-state-license-if-non-commercial","status":"publish","type":"post","link":"http:\/\/www.pauljjhansen.com\/?p=1778","title":{"rendered":"Even CA state employees need not have a state license if non-commercial."},"content":{"rendered":"<h1>California Code, Vehicle Code &#8211; VEH \u00a7 12501<\/h1>\n<p>12501.\u00a0 The following persons are <span style=\"color: #ff0000;\">not<\/span> required to obtain a driver\u2019s license:<br \/>\n(a) An officer or employee of the United States, while operating a motor vehicle owned or controlled by the United States on the business of the United States, <span style=\"color: #ff0000;\">except<\/span> when the motor vehicle being operated is a <span style=\"color: #ff0000;\"><strong>commercial motor vehicle<\/strong><\/span>, as defined in Section 15210.<\/p>\n<p>&nbsp;<\/p>\n<h1>California Code, Vehicle Code &#8211; VEH \u00a7 15210<\/h1>\n<pre>15210.  Notwithstanding any other provision of this code, as used in\r\nthis chapter:\r\n   (a) \"Commercial driver's license\" means a driver's license issued\r\nby a state or other jurisdiction, in accordance with the standards\r\ncontained in Part 383 of Title 49 of the Code of Federal Regulations,\r\nwhich authorizes the licenseholder to operate a class or type of\r\n<strong>commercial motor vehicle<\/strong>.\r\n   (b) (1) \"Commercial motor vehicle\" means any vehicle or\r\ncombination of vehicles which requires a <strong>class A<\/strong> or <strong>class B<\/strong> license,\r\nor a <strong>class C<\/strong> license with an endorsement issued pursuant to paragraph\r\n(4) of subdivision (a) of Section 15278.\r\n   (2) \"Commercial motor vehicle\" <span style=\"color: #ff0000;\">does not include<\/span> any of the\r\nfollowing:\r\n   (A) A <span style=\"color: #0000ff;\">recreational vehicle<span style=\"color: #99cc00;\">**<\/span><\/span>, as defined in Section 799.24 of the\r\nCivil Code.\r\n   (B) Military equipment operated by noncivilian personnel, which is\r\nowned or operated by the United States Department of Defense,\r\nincluding the National Guard, as provided in Parts 383 and 391 of\r\nTitle 49 of the Code of Federal Regulations.\r\n   (C) An implement of husbandry operated by a person who is not\r\nrequired to obtain a driver's license under this code.\r\n   (D) Vehicles operated by persons exempted pursuant to Section\r\n25163 of the Health and Safety Code or a vehicle operated in an\r\nemergency situation at the direction of a peace officer pursuant to\r\nSection 2800.\r\n   (c) \"Controlled substance\" has the same meaning as defined by the\r\nfederal Controlled Substances Act (21 U.S.C. Sec. 802).\r\n   (d) \"Disqualification\" means a prohibition against driving a\r\ncommercial motor vehicle.\r\n   (e) \"Employer\" means any person, including the United States, a\r\nstate, or political subdivision of a state, who owns or leases a\r\ncommercial motor vehicle or assigns drivers to operate such a\r\nvehicle.  A person who employs himself or herself as a commercial\r\nvehicle driver is considered to be both an employer and a driver for\r\npurposes of this chapter.\r\n   (f) \"Felony\" means an offense under state or federal law that is\r\npunishable  by death or imprisonment for a term exceeding one year.\r\n   (g) \"Gross combination weight rating\" means the value specified by\r\nthe manufacturer as the maximum loaded weight of a combination or\r\narticulated vehicle.  In the absence of a value specified by the\r\nmanufacturer, gross vehicle weight rating will be determined by\r\nadding the gross vehicle weight rating of the power unit and the\r\ntotal weight of the towed units and any load thereon.\r\n   (h) \"Gross vehicle weight rating\" means the value specified by the\r\nmanufacturer as the maximum loaded weight of a single vehicle, as\r\ndefined in Section 390.\r\n   (i) \"Serious traffic violation\" includes either of the following:\r\n\r\n   (1) Excessive speeding, as defined pursuant to the federal\r\nCommercial Motor Vehicle Safety Act (P.L. 99-570).\r\n   (2) Reckless driving, as defined pursuant to the federal\r\nCommercial Motor Vehicle Safety Act (P.L. 99-570).\r\n   (3) A violation of any state or local law involving the safe\r\noperation of a motor vehicle, arising in connection with a fatal\r\ntraffic accident.\r\n   (4) Any other similar violation of a state or local law involving\r\nthe safe operation of a motor vehicle,  as defined pursuant to the\r\nCommercial Motor Vehicle Safety Act (Title XII of P.L. 99-570).\r\n   <span style=\"font-size: xx-small;\"><b>In the absence of a federal definition, existing definitions under\r\nthis code shall apply.<\/b><\/span>\r\n   (j) \"State\" means a state of the United States or the District of\r\nColumbia.\r\n   (k) \"Tank vehicle\" means any commercial motor vehicle that is\r\ndesigned to transport any liquid or gaseous material within a tank\r\nthat is permanently or temporarily attached to the vehicle or the\r\nchassis, including, but not limited to, cargo tanks and portable\r\ntanks, as defined in Part 171 of Title 49 of the Code of Federal\r\nRegulations.  This definition does not include portable tanks having\r\na  rated capacity under 1,000 gallons.\r\n&gt;&gt;\r\n<a href=\"http:\/\/www.search-california-law.com\/research\/titles\/ca\/index.html\">California<\/a>\u00a0\/\u00a0<a href=\"http:\/\/www.search-california-law.com\/research\/titletoc\/ca\/CIV\/index.html\">Civil Code - CIV<\/a>\u00a0\/\u00a0<a href=\"http:\/\/www.search-california-law.com\/research\/section\/ca\/CIV\/7.2.2.4.1\/index.html\">ARTICLE 1. Definitions [799.20. - 799.32.]<\/a>\u00a0\/\u00a0<a href=\"http:\/\/www.search-california-law.com\/research\/ca\/CIV\/799.29.\/Cal-Civil-Code-Section-799.29\/text.html\">Section 799.29.<\/a>\u00a0\r\n\r\nSection 799.29. Civil Code \u00a7799.29.<\/pre>\n<p>\u201cRecreational vehicle<span style=\"color: #99cc00;\">**<\/span>\u201d has the same meaning as defined in Section 18010 of the Health and Safety Code.<\/p>\n<blockquote><p>&gt;<\/p><\/blockquote>\n<h5><b><strong>CHAPTER 1. Definitions [18000 &#8211; 18014.5]<\/strong><\/b><\/h5>\n<p style=\"font-weight: 400;\"><em>\u00a0\u00a0( Chapter 1 added by Stats. 1981, Ch. 975, Sec. 3. )<\/em><\/p>\n<p><br style=\"font-weight: 400;\" \/><span style=\"font-weight: 400;\">\u00a0\u00a0<\/span><b><\/b><\/p>\n<h6><b><strong>18010.\u00a0\u00a0<\/strong><\/b><\/h6>\n<p>\u201cRecreational vehicle<span style=\"color: #99cc00;\">**<\/span>\u201d means both of the following:<\/p>\n<p>(a) \u00a0A <span style=\"color: #ff0000;\">motorhome<\/span>, travel trailer, truck camper, or camping trailer, with or without motive power, designed for human habitation for <span style=\"color: #ff0000;\">recreational<\/span>, emergency, or other occupancy, that meets all of the following criteria:<\/p>\n<p>(1) \u00a0It contains <span style=\"color: #ff0000;\">less<\/span> than 320 square feet of internal living room area, excluding built-in equipment, including, but not limited to, wardrobe, closets, cabinets, kitchen units or fixtures, and bath or toilet rooms. (<span style=\"color: #0000ff;\">Comment by Hansen &gt; Any car qualifies.<\/span>)<\/p>\n<p>(2) \u00a0It contains 400 square feet or <span style=\"color: #ff0000;\">less<\/span> of gross area measured at maximum horizontal projections.<\/p>\n<p>(3) \u00a0It is built on a single chassis.<\/p>\n<p>(4) \u00a0It is either self-propelled, truck-mounted, or permanently towable on the highways without a permit.<\/p>\n<p>(b) \u00a0A park trailer, as defined in Section 18009.3.<\/p>\n<blockquote><p>&gt;<\/p>\n<p>Conclution in my (Hansen&#8217;s) oppinion: Just as privite people need not have a license, it is the same for any state employee, that unless they are ingaged in a regulatable activity, nether are required to be governed except by common law, thus no state license regulation is applicable.
