{"id":236,"date":"2011-02-25T22:50:32","date_gmt":"2011-02-25T22:50:32","guid":{"rendered":"http:\/\/www.pauljjhansen.com\/?p=236"},"modified":"2018-03-10T20:43:05","modified_gmt":"2018-03-10T20:43:05","slug":"land-patent-proof-of-non-usa-owned-land","status":"publish","type":"post","link":"http:\/\/www.pauljjhansen.com\/?p=236","title":{"rendered":"Land Patent, Proof of non-USA owned land."},"content":{"rendered":"<p>Each township (See township grid) were sub-divided into thirty-six &#8220;sections&#8221; of one square mile (2.59 km) or 640 acres.<\/p>\n<p>One can\/should have a location by &#8220;township&#8221; and <strong>not<\/strong> use the CITY, STATE, or COUNTY, or with the USA \/ US that all Attorneys use to trap you into the tax role of a county. \u00a0If you are &#8220;in&#8221; the county you must pay county taxes, but they do not tell you that &#8220;county&#8221; is a federal possession within the exterior boundaries of a state (Nebraska).<\/p>\n<p>You see CITY, STATE, COUNTY are all terms the US Code uses to identify &#8220;possessions&#8221;\u00a0or &#8220;territories&#8221; of the US, therefore starts the process,\u00a0falsely,\u00a0 that it is a type that qualifies as a taxable property, thus the assessor adds it to the tax role. \u00a0You can thank your attorney for this.<\/p>\n<p>&gt;&gt;&gt;<\/p>\n<p>The below is a land location\/description\u00a0that <strong>does not<\/strong> associate itself with a CITY, STATE, or COUNTY, or with the USA \/ US.<\/p>\n<p>Location of the subject Land:<\/p>\n<p>America as in the 50 states united, Nebraska, Section 28, Township 15, Range 13, North \u00c2\u00bd of the North West 1\/4., Hanscom Place Subdivision, Lot 4, Block 10, East 142 feet, 50 feet by 142 feet consisting of 16.299 percent of one acre of land, all being <strong>without<\/strong> the United States.<\/p>\n<p>(The statement &#8220;<strong>without<\/strong> the United States&#8221; simply means- not a\u00a0possession\u00a0or territory of the United States.)<\/p>\n<p>(Make sure you do not use the term &#8220;The United States of America&#8221; for that is\u00a0technically\u00a0different, stick with the United States .)<\/p>\n<p>For a small fee, I can review a new deed, to replace your current one, for filing so that your property can be noticed as not a taxable US\u00a0possession.<\/p>\n<p>Just email me at <strong>pauljjhansenlaw@gmail.com<\/strong><\/p>\n<p>&gt;&gt;&gt;<\/p>\n<p>Land Patent &#8211; Proof that the USA does not own your land, therefore sold its exclusive right to proprietary ownership and governance:<\/p>\n<p>I present the following in the hope that you will educate yourself with the truth and prepare yourself to stand, as our forefathers did, and as the founding fathers<br \/>\nof this nation did, with your Land, Liberty, and Rights intact.<\/p>\n<p><span style=\"color: #ff0000;\">By definition a Land Patent is the only form of proof of absolute title to land in America. \u00a0<\/span>A patent is the highest evidence of title and is conclusive as against the government and all claiming under junior patents or title- U.S. v. Stone 2 US 525. \u00a0The patented grant of land is a public law standing on the statute books of the State and is notice to every subsequent purchaser under any conflicting sale made afterward. Wineman v. Gastrell \u00c2\u00a02 U.S. App. 581.<br \/>\nState statutes that give less authoritative ownership of title than the patent cannot even be brought into federal court- Langdon v. Sherwood, \u00a0124 U.S. 74, 81.<\/p>\n<p>Land patents are granted to the named party and to their heirs and assigns forever. Therefore, to have ultimate ownership of land you must have a proper chain of title<br \/>\nsecured to an <span style=\"color: #ff0033;\">assigned underlying land patent<\/span>, or you could lose your land in a land contest.<\/p>\n<p>First, you must have evidence ownership to the land: \u00a0 Generally a &#8220;Deed&#8221;.<br \/>\nSecond, find the land location description.<br \/>\nSince the Constitutional Republic has been formed virtually the rest of the country was mapped in <span style=\"color: #ff0000;\">Section, Township, and Range format (hereafter)<\/span>.<br \/>\nThird, with the description of your Land in STRf, you are ready to go acquire a copy of the appropriate Land Patent for your Land. \u00a0This is done by taking the legal<br \/>\ndescription of your Land, in STRf, to the Bureau of Land Management (BLM) and asking them (in their Land Patent records office) for a <span style=\"color: #ff0000;\">Certified copy of the Land Patent<\/span> for the land represented by your Land description including, Section, Township, and Range. \u00a0It&#8217;s a good idea to get at least two certified copies of the appropriate Patent and a copy of the &#8220;Patent Plat map&#8221; for the particular Township your land is in.<\/p>\n<p>There are several groups that claim all kinds of advantages of buying their Land Patent information. \u00a0I believe they are all a waste of money. \u00a0A Land Patent was most likely filed on your property in the 1800s, there is no legal need to refile it. \u00a0It is a deed just like any other deed, one filing only.<\/p>\n<p>Patents sometimes called Warrants are proof that the USA does not own the land anymore. \u00a0There are only two types of land ownership in America, land owned by the USA, and the other is Land not owned by the USA.<\/p>\n<p>If not owned the USA has no\u00a0proprietary\u00a0ownership rights with the land. \u00a0That leaves it free. \u00a0Free should mean no governance in any way from the USA or any of its\u00a0subdivisions\u00a0 \u00a0Subdivisions are City, State, County, agents from these subdivisions are USA employees.<\/p>\n<p>If no contract exists between you and the USA they have no legal right to: tax, apply city code, apply a statutory law, etc. to your private land without a fully known consensual contract with the USA.<\/p>\n<p>The Lawyer that made you last deed made sure that it was done in such a way as to give presumption that it is yet owned by the USA so that it could be kept on the County tax roll.<\/p>\n<p>Just look it will say in the County of _________, City of __________, State of ____________. \u00a0All those are USA owned land\/entities. \u00a0How much did you pay this Lawyer for selling you out?<\/p>\n<p>I&#8217;ll be adding what the deed should say to distinguish the difference of non-USA from USA held land.<\/p>\n<p>Or Email me at &gt; \u00a0 pauljjhansen@hotmail.com<\/p>\n<p>A clear DEED should have the following:<br \/>\nFile it in the Clerk and Recorder&#8217;s office with the land records of the county. \u00a0(&#8220;file for record&#8221;, do not &#8220;record&#8221; [&#8220;record&#8221; is statutory])<\/p>\n<h1>&gt;&gt;&gt;<\/h1>\n<h1>Below is an example of an associated Act with one of the Land Patents that my Land is associated with, each Patent\/Warrant has a specific Congressional Act supporting it.<\/h1>\n<h1>((No stipulation of state ownership, or governance ability (property tax).))<\/h1>\n<h1>10 Stat. 701<\/h1>\n<h3>CHAP. CCVII.- An Act in Addition to certain Acts granting Bounty Land to certain Officers and Soldiers who have been engaged in the Military Service of the United States.<\/h3>\n<p><em>Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled<\/em>, That each of the surviving commissioned and non-commissioned officers, musicians, and privates, whether of regulars, volunteers, rangers, or militia, who were regularly mustered into the service of the United States, and every officer, commissioned and non-commissioned, seaman, ordinary seaman, flotilla-man, marine, clerk, and landsman in the navy, in any of the wars in which this country has been engaged since seventeen hundred and ninety, and each of the survivors of the militia, or volunteers, or State troops of any State or Territory, called into military service, and regularly mustered therein, and whose services have been paid by the United States, shall be entitled to receive a certificate or warrant from the Department of the Interior for one hundred and sixty acres of land; and where any of those who have so been mustered into service and paid shall have received a certificate or warrant, he shall be entitled to a certificate or warrant for such quantity of land as will make, in the whole, with what he may have heretofore received, one hundred and sixty acres to each such person having served as aforesaid: <em>Provided<\/em>, The person so having been in service shall not receive said land warrant if it shall appear by the muster-rolls of his regiment or corps that he deserted, or was dishonorably discharged from service: <em>Provided further<\/em>, That the benefits of this section shall be held to extend to wagon-masters and teamsters who may have been employed, under direction of competent authority in time of war in the transportation of military stores and supplies.<\/p>\n<p>SEC. 2. <em>And be it further enacted<\/em>, That in case of the death of any person who, if living, would be entitled to a certificate or warrant as aforesaid under this act, leaving a widow, or, if no widow, a minor child or children, such widow, or, if no widow, such minor child or children, shall be entitled to receive a certificate or warrant for the same quantity of land that such deceased person would be entitled to receive under the provisions of this act, if now living: <em>Provided<\/em>, That a subsequent marriage shall not impair the right of any such widow to such warrant if she be a widow at the time of making her application: <em>And provided, further<\/em>, That those shall be considered minors who are so at the time this act shall take effect.<\/p>\n<p>SEC. 3. <em>And be it further enacted<\/em>, That in no case shall any such certificate or warrant be issued for any service less than fourteen days, except where the person shall actually have been engaged in battle, and unless the party claiming such certificate or warrant shall establish his or her right thereto by record evidence of said service.<\/p>\n<p>SEC. 4. <em>And be it further enacted<\/em>, That said certificates or warrants may be assigned, transferred, and located by the warrantees, their assignees, or their heirs-at-law, according to the provisions of existing laws regulating the assignment, transfer, and location of bounty-land warrants.<\/p>\n<p>SEC. 5. <em>And be it further enacted<\/em>, That no warrant issued under the provisions of this act shall be located on any public lands, except such as shall at the time be subject to sale at either the minimum or lower graduated prices.<\/p>\n<p>SEC. 6. <em>And be it further enacted<\/em>, That the registers and receivers of the several land -offices shall be severally authorized to charge, and receive for their services, in locating all warrants under the provisions of this act, the same compensation or percentage to which they are entitled by law, for sales of the public lands, for cash, at the rate of one dollar and twenty-five cents per acre; the said compensation to be paid by the assignees or holders of such warrants.<\/p>\n<p>SEC. 7. <em>And be it further enacted<\/em>, That the provisions of this act, and all the bounty-land laws heretofore passed by Congress, shall be extended to Indians, in the same manner, and to the same extent, as if the said Indians had been white men.<\/p>\n<p>SEC. 8. <em>And be it further enacted<\/em>, That the officers and soldiers of the revolutionary war, or their widows or minor children, shall be entitled to the benefits of this act.<\/p>\n<p>SEC. 9. <em>And be it further enacted<\/em>, That the benefits of this act shall be applied to and embrace those who served as volunteers at the invasion of Plattsburg, in September, eighteen hundred and fourteen; Hansen has exclusive <strong><span style=\"text-decoration: underline;\">proprietary<\/span><\/strong> ownership of the said Land;<\/p>\n<p>-that Paul John Hansen is a <strong><span style=\"text-decoration: underline;\">free inhabitant<\/span><\/strong> as found in Article IV of the \u00c2\u00a0Articles of Confederation of November 15, 1777;<\/p>\n<p>-that the Plaintiff has failed to place any evidence on the record as to how it is that his Certified Tax Certificate has a supporting <strong><span style=\"text-decoration: underline;\">promulgation<\/span><\/strong> rule to touch the subject Land;<\/p>\n<p>-that the Plaintiff has failed to place any evidence on the record of how the Douglas County District Court, a United States of America Court, has <strong><span style=\"text-decoration: underline;\">jurisdiction<\/span><\/strong> over me as a said &#8220;free inhabitant&#8221;;<\/p>\n<p>-that the captioned Court granted a summary judgment lacking both evidence of personal, territorial, and subject matter <strong><span style=\"text-decoration: underline;\">jurisdiction<\/span><\/strong>.<\/p>\n<p><strong>WHEREFORE<\/strong>, the undersigned, respectfully notices Timothy F. \u00a0I ask for an opportunity to meet at your office at any time convenient to you to <strong>discuss<\/strong> the implications of the above issue.<\/p>\n<p><strong><span style=\"text-decoration: underline;\">Organic Law<\/span><\/strong>, (Foundational) Law of the Land (territory) and the Owners (People or entities),<\/p>\n<p>Associate Students,<\/p>\n<p>All written law has to be studied as a progression from an earlier written law called Organic Law. \u00a0All presently written law governments are in power because the people believe so-called democratic governments supplant prior Organic Laws with an amendable constitution. \u00a0The people of the United States of America have come to believe they, as voters are in control of a government called a democratic republic. \u00a0The written law must always be written to describe its own territorial limitations and the Organic Laws of the United States of America is no exception.<\/p>\n<p>In chronological order, the Organic Laws of the United States of America are the Declaration of Independence of July 4, 1776, the Articles of Confederation of November 15, 1777, the Northwest Ordinance of July 13, 1787, and the Constitution of September 17, 1787.<\/p>\n<p>The Declaration of Independence dissolved the political bands which had connected the United States of America with Great Britain but left the English common law intact.<\/p>\n<p>The Articles of Confederation formed the thirteen (13) States into a <strong><span style=\"text-decoration: underline;\">perpetual<\/span><\/strong> Union, the <strong><span style=\"text-decoration: underline;\">Confederacy<\/span><\/strong>, known also, as the United States of <strong><span style=\"text-decoration: underline;\">America<\/span><\/strong>.<\/p>\n<p>The Northwest Ordinance of July 13, 1787, provided a <strong><span style=\"text-decoration: underline;\">temporary<\/span><\/strong> government and initiated a law of the land for all (only) the territory owned by the United States of America. \u00a0Specifically, in Article V, settlers and inhabitants of the lands subject to the exclusive jurisdiction of the United States of America were made subject to federal taxes to pay down the federal debt.<\/p>\n<p>The Constitution of September 17, 1787, made the <strong><span style=\"text-decoration: underline;\">temporary<\/span><\/strong> government over the territory and other property belonging to the United States of America <strong><span style=\"text-decoration: underline;\">permanent<\/span><\/strong> in the form set out in that Constitution. \u00a0(All Land <strong><span style=\"text-decoration: underline;\">not<\/span><\/strong> owned by the USA is then owned by <strong><span style=\"text-decoration: underline;\">free inhabitants<\/span><\/strong>.)<\/p>\n<p>The claimed government powers of the Constitution of September 17, 1787, all pre-existed that Constitution. \u00a0The legislative Powers granted in Article I Section 1 were those proprietary powers obtained <strong><span style=\"text-decoration: underline;\">from<\/span><\/strong> King George III and other owners of North American territory. \u00a0The executive power vested in a President of the United States of America in Article II Section 1 Clause 1 is placed in that Office when the first nine States ratify &#8220;this Constitution.&#8221; \u00a0That ratification is the exercise of the power of nine States under the authority of Article IX of the Articles of Confederation to form a Committee of States with an executive officer.<\/p>\n<p>The Constitution of September 17, 1787, according to Article VII, is established when nine (nine of the thirteen) States ratify it. \u00a0It can even be said those States adopt that Constitution, however, in order for the Constitution of September 17, 1787, to be more than a trigger for Article IX of the Articles of Confederation of November 15, 1777, <strong><span style=\"text-decoration: underline;\">it must be adopted<\/span><\/strong> by officers identified in Article VI Clause 3.<\/p>\n<p>Adoption of &#8220;this Constitution&#8221; takes place, when &#8220;The Senators and Representatives before mentioned, and the Members of the several State Legislatures, and <strong><span style=\"text-decoration: underline;\">all<\/span><\/strong> executive and judicial Officers, both of the United States and of the several States, shall be bound by Oath or Affirmation, \u00c2\u00a0to support this Constitution.&#8221; \u00a0In the absence of the binding oaths of its Officers &#8220;this Constitution&#8221; is without support.&#8221; \u00a0The documentary history of this period is clear there are no Officers who swear or affirm &#8220;to support this Constitution.&#8221; \u00a0History, in fact, records oaths and affirmations are taken and subscribed to the same &#8220;Constitution&#8221; George Washington swore to &#8220;preserve, protect and defend.&#8221;<\/p>\n<p>Instead of taking and subscribing the very simple oath &#8220;<strong><span style=\"text-decoration: underline;\">to support this Constitution<\/span><\/strong>,&#8221; George Washington, who was elected President of the United States of America on February 4, 1789, takes the oral oath of Office of President of the United States on April 30, 1789. \u00a0Washington was, of course, aware the Office of President of the United States was an appointive office, which he had the power to appoint with the advice and consent of the new Senate. \u00a0There was another appointive office, the Article II Section 1 Clause 5 Office of President, which could not be filled by Presidential appointment until July 4, 1790, the date the &#8216;fourteen Years a Resident within the United States&#8221; requirement could be satisfied.<\/p>\n<p>The <strong><span style=\"text-decoration: underline;\">legislative<\/span><\/strong> (lawmakers for a defined territory) branch of any government must be limited to the one that existed at the time of the Northwest Ordinance of July 13, 1787, because a Congress of the United States consisting a Senate and House of Representatives could not be formed until newly elected Senators could meet the &#8220;nine Years a Citizen of the United States&#8221; requirement of Article I Section 3 Clause 3.<\/p>\n<p>The State of \u00a0New Hampshire on June 21, 1788, became the ninth State to ratify &#8220;this Constitution&#8221; establishing that &#8220;Constitution between the States so ratifying the Same.&#8221; \u00a0That ratification was sufficient to invoke Article IX of Articles of Confederation of November 15, 1777, but only the passage of time to March 1, 1790, would allow the Senators to qualify for their Offices under &#8220;this Constitution.&#8221;
