THAT\u00e2\u20ac\u2122S <\/span><\/strong><strong><span style=\"text-decoration: underline;\">ALL<\/span><\/strong><strong><span style=\"text-decoration: underline;\"> YOU HAD TO DO<\/span><\/strong><strong>!<\/strong><strong> You are assuming they will deny you this right and you are trying to strategize how to accomplish this. All you have to do is demand to see them, P.E.R.I.O.D.<\/strong><\/p>\n<p><strong>LISTEN, if they deny you, it would be in writing, because I\u00e2\u20ac\u2122m sure they will not come to you face to face to tell you \u00e2\u20ac\u0153NO\u00e2\u20ac\u009d.\u00c2\u00a0\u00c2\u00a0 But if they put the denial in writing, and you got that paper in your hand, THAT alone would be enough to have your case over turned! <\/strong><\/p>\n<p><strong>You want to see the file on your case so you can win, but if you get a denial to see your file, you would win with that too!<br \/>\n<\/strong><strong><br \/>\n<\/strong>And any <span style=\"text-decoration: underline;\">Exculpatory evidence<\/span> that the prosecutor had or knew of MUST be given to you. They cannot hide information that they know shows your innocence.\u00c2\u00a0 They KNEW for example that the irs does not have jurisdiction within the 50 states united, which is where you were engaged in a PRIVATE contract with your private employees.\u00c2\u00a0 If prosecutors knew, (which they most likely did know), that the Grand Jury did NOT issue an Indictment of you, then the prosecutors were operating in FRAUD by pretending that the Grand Jury DID issue an Indictment.\u00c2\u00a0\u00c2\u00a0 FRAUD is NOT Due Process of Law and therefore they lost any jurisdiction that might have otherwise had.\u00c2\u00a0 <strong>No Jurisdiction, No Case, No Valid Judgment!<\/strong><\/p>\n<p><strong>2. <\/strong><strong>If there is nothing there in that file, then you have to file a Demand for Concurrence,<br \/>\nwhich means you demands that all the jury members involved concur (<\/strong><strong><span style=\"text-decoration: underline;\">AGREE<\/span><\/strong><strong>), that they received the information from the prosecutor and on the basis of that information, issued their Indictment.<\/strong><br \/>\n<strong><br \/>\nIf<\/strong><strong> there is <span style=\"text-decoration: underline;\">no<\/span> information given to the Grand Jury by the prosecutor then there is nothing upon which the Grand Jury can <span style=\"text-decoration: underline;\">AGREE WITH<\/span>, and that is Prima Facia evidence that the prosecutors perpetrated a fraud against YOU! A fraud which is grounds for the attorney&#8217;s to be disbarred and for you to be released immediately for fraud in the Indictment. <\/strong><\/p>\n<p>&nbsp;<\/p>\n<p><strong>3. <\/strong><strong>When you see that there was no information given to the Grand Jury, you can then<br \/>\nfile an &#8220;Admission to the Clerk&#8221; showing there never was any Charge against you.<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p><strong>From Marty who wanted to add this as well:<\/strong><\/p>\n<p>[Christine, Dick may want to look carefully at the difference between Coram nobis and Coram non judice.\u00c2\u00a0 Coram nobis is a procedural tool whose purpose is to correct errors of fact only, and its function is to bring before the court rendering the judgment matters of fact which, if known at time judgment was rendered, would have prevented its rendition. The Coram nobis is directed to the Court that made the error, rather<br \/>\nthan to a higher court.<br \/>\nCoram non judice is about a court which had no jurisdiction in the matter, making the judgment <strong>void<\/strong>.\u00c2\u00a0 In Dick\u00e2\u20ac\u2122s<br \/>\ncase there is probably a mixture of errors of fact and errors of procedure.\u00c2\u00a0 Most fundamental fact is that Dick had a <strong>private<\/strong> contract with his employees and that contract did NOT involve the irs as a third party.\u00c2\u00a0 All government officials took solemn oaths to uphold Dick\u00e2\u20ac\u2122s right to contract or not contract with<br \/>\nhis <strong>private<\/strong> employees, yet all those officials betrayed their oaths by forcing Dick into a three party<br \/>\ncontract against his will.\u00c2\u00a0 That of itself left government officials without jurisdiction over Dick.\u00c2\u00a0 But if, on top of all that, they also failed to abide by <strong>Due Process<\/strong> of Law in securing a <strong>proper<\/strong> Grand Jury<br \/>\nIndictment, then again they lost <strong>jurisdiction<\/strong> before they even went to trial with a jury of twelve in Texas.<br \/>\nIf there was no actual Grand Jury Indictment or the Indictment was based upon false information given by<br \/>\nprosecutors to the Grand Jury, then there was NO JURISDICTION to proceed against Dick.<br \/>\nSee supporting case law below]<\/p>\n<p>&nbsp;<\/p>\n<p>Amendment VI of the USA Constitution:<\/p>\n<p>In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trail, by an impartial jury of<br \/>\nthe State and district wherein the crime shall have been committed; which district shall have been previously ascertained by law, and <strong>to be informed of the nature and cause of the accusation<\/strong>; <strong>to be confronted with the witnesses against him;<\/strong> to have compulsory process for obtaining witnesses in his favor, and to have the assistance<br \/>\nof counsel for his defense.<\/p>\n<p><em> <\/em><\/p>\n<p><em>Hale v. Henkel<\/em>, 201 U.S. 43: \u00e2\u20ac\u0153The individual may stand upon his constitutional rights as a<\/p>\n<p>citizen. He is entitled to carry on his <strong>private <\/strong>business in his own way. His power to<\/p>\n<p>contract is unlimited. He owes no duty to the state or to his neighbors to divulge his<\/p>\n<p>business, or to open his doors to an investigation, so far as it may tend to criminate him.<\/p>\n<p>He owes no such duty to the state, since he received nothing therefrom beyond the<\/p>\n<p>protection of his life and property. His rights are such as existed long antecedent to the<\/p>\n<p>organization of the state, and can only be taken from him by <strong>due process of law<\/strong> <strong>and in<\/strong><\/p>\n<p><strong> accordance with the Constitution<\/strong>.\u00e2\u20ac\u009d<\/p>\n<p>&nbsp;<\/p>\n<p><em>Florida Evidence Code, Rule 50.501<\/em> Except as otherwise provide by this chapter, any<\/p>\n<p>other statute, or the Constitution of the United States or of the State of Florida, no person<\/p>\n<p>in a legal proceeding has a privilege to:<\/p>\n<p>(1)\u00c2\u00a0 Refuse to be a witness<\/p>\n<p>(2)\u00c2\u00a0 Refuse to disclose any matter<\/p>\n<p>(3)\u00c2\u00a0 Refuse to produce any object or writing<\/p>\n<p>(4) Prevent another from being a witness, from disclosing any matter, or from producing<\/p>\n<p>any object or writing.<\/p>\n<p>(Dick may want to search for a similar Evidence Code in Texas, but even if he can\u00e2\u20ac\u2122t find<\/p>\n<p>such for Texas, he can rely upon Florida law by way of Article IV of the U.S. constitution)<\/p>\n<p>&nbsp;<\/p>\n<p><em>Honomichl v. State<\/em> 333 N.W.2d 797 (S.D. 1983): \u00e2\u20ac\u0153Without a <strong><span style=\"text-decoration: underline;\">formal and sufficient <\/span><\/strong><\/p>\n<p><strong><span style=\"text-decoration: underline;\">indictment or information<\/span><\/strong>, a court does not acquire subject-matter jurisdiction, and thus,<\/p>\n<p>an accused may not be punished for a crime. The <strong><span style=\"text-decoration: underline;\">court must have personal and subject<\/span><\/strong><\/p>\n<p><strong> <span style=\"text-decoration: underline;\">matter jurisdiction before it may act on a criminal charge.\u00e2\u20ac\u009d<\/span><\/strong> [MUST be a formal AND<\/p>\n<p>and SUFFICIENT Indictment!]<\/p>\n<p>&nbsp;<\/p>\n<p><strong> <\/strong><em>Machibroda\u00c2\u00a0v\u00c2\u00a0US<\/em>, 368\u00c2\u00a0US\u00c2\u00a0487; Albrecht\u00c2\u00a0v\u00c2\u00a0US, 273\u00c2\u00a0US\u00c2\u00a01. \u00c2\u00a0\u00e2\u20ac\u0153Jurisdiction\u00c2\u00a0is acquired by<\/p>\n<p>statutory authorization <strong>and valid process<\/strong> but <strong><span style=\"text-decoration: underline;\">not by a\u00c2\u00a0plea<\/span><\/strong>. \u00c2\u00a0A\u00c2\u00a0plea of guilty when the<\/p>\n<p>court does not have jurisdiction does not vest jurisdiction in the\u00c2\u00a0court nor does it bar a<\/p>\n<p>challenge to\u00c2\u00a0jurisdiction. \u00c2\u00a0Without\u00c2\u00a0jurisdiction, all\u00c2\u00a0orders are\u00c2\u00a0<strong><span style=\"text-decoration: underline;\">void<\/span><\/strong> (not\u00c2\u00a0merely\u00c2\u00a0voidable)<\/p>\n<p>and\u00c2\u00a0fines, penalties, restitution,\u00c2\u00a0etc., are\u00c2\u00a0refundable.\u00e2\u20ac\u009d<\/p>\n<p>&nbsp;<\/p>\n<p><em>Ligon v. Williams<\/em> 637 NE 2d 633 (1<sup>st<\/sup> Dist. 1994): 5. \u00e2\u20ac\u0153<strong><span style=\"text-decoration: underline;\">Void judgment may be attacked at<\/span><\/strong><\/p>\n<p><strong><span style=\"text-decoration: underline;\">any time, directly or collaterally<\/span><\/strong>, and petitioner need not demonstrate due diligence and<\/p>\n<p>meritorious claims or defense if <strong><span style=\"text-decoration: underline;\">seeking relief from void judgment<\/span><\/strong>.\u00e2\u20ac\u009d\u00c2\u00a0 8. \u00e2\u20ac\u0153<strong>Orders entered by <span style=\"text-decoration: underline;\">court<br \/>\nin absence of justiciable issue properly presented by parties are void<\/span>, as they result from court<br \/>\naction which exceeds its jurisdiction.\u00e2\u20ac\u009d<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p><em>Nestor v. Hershey<\/em>, 425 F2d 504 <span style=\"text-decoration: underline;\">Want of Jurisdiction makes \u00e2\u20ac\u0153&#8230;all acts of judges<\/span>, magistrates,<\/p>\n<p>U.S. Marshals, sheriffs, local police, <span style=\"text-decoration: underline;\">all <strong>void<\/strong> and not just voidable.\u00e2\u20ac\u009d <\/span><\/p>\n<p>&nbsp;<\/p>\n<p><em>Kloss v. State<\/em> 116 So. 39: \u00e2\u20ac\u0153An attorney is an officer of the court, and he owes the duty of<\/p>\n<p>good faith and honorable dealing to the courts before whom he practices his profession. His<\/p>\n<p>high vocation is to <em>inform<\/em> the court as to the <em>law <\/em>and <em>facts <\/em>of the case and to <em>aid <\/em>it in doing<\/p>\n<p><em>justice <\/em>and at arriving at a <em>correct <\/em>conclusion. He <strong>violates his oath<\/strong> of office when he resorts<\/p>\n<p>to <strong>deception<\/strong> <strong>or allows his client to<\/strong>.\u00e2\u20ac\u009d<\/p>\n<p><em>Dodd v. Florida Bar<\/em>, Fla 118 So2d 17: \u00e2\u20ac\u0153The primary function of trial court proceedings is<\/p>\n<p>to <strong>find the truth<\/strong>, i.e. the true facts, in disputes between man and his neighbor and man and<\/p>\n<p>his government, in order that the applicable law may be applied thereto so as to reach a just<\/p>\n<p>conclusion.\u00c2\u00a0 When an attorney adds <strong>or<\/strong> <strong>allows false testimony<\/strong> to be cast into the crucible<\/p>\n<p>from which the <strong>truth <\/strong>is to be refined and taken to be weighed on the scales of justice, he<\/p>\n<p>makes impure the product and makes it impossible for the scales of justice to balance.\u00c2\u00a0 No<\/p>\n<p>breach of professional ethics, or of the law, is more harmful to the administration of justice<\/p>\n<p>or more hurtful to the public appraisal of the legal profession than the knowledgeable use by<\/p>\n<p>an attorney of false testimony in the judicial process.
