a &#8220;Free Inhabitant&#8221; License Meets State Standards."},"content":{"rendered":"<p>California\u00a0<strong>VEHICLE CODE<\/strong><strong>\u00a0<\/strong><br \/>\n<strong>SECTION 12500-12527<\/strong><\/p>\n<p><strong>[[ All comments in [[ brackets ]] are comments made by Paul John Hansen.\u00a0 ]]<\/strong><\/p>\n<p>12505.\u00a0 (a) (1) For purposes of this division only and<\/p>\n<p>notwithstanding Section 516, <strong><span style=\"text-decoration: underline;\">residency shall be determined<\/span><\/strong> as a<\/p>\n<p>person&#8217;s state of domicile. &#8220;State of domicile&#8221; means the state where<\/p>\n<p>a person has his or her true, fixed, and permanent home and<\/p>\n<p>principal residence and to which he or she has manifested the<\/p>\n<p>intention of returning whenever he or she is absent.<\/p>\n<p>Prima facie evidence of residency for driver&#8217;s licensing purposes<\/p>\n<p>includes, but is not limited to, the following:<\/p>\n<p>(A) Address where <strong><span style=\"text-decoration: underline;\">registered to vote<\/span><\/strong>.\u00a0 [[ <strong><span style=\"text-decoration: underline;\">I am not a registered voter.]]<\/span><\/strong><\/p>\n<p>(B) Payment of <span style=\"text-decoration: underline;\">resident tuition<\/span> at a public institution of higher<\/p>\n<p>education.<\/p>\n<p>(C) Filing a homeowner&#8217;s <strong><span style=\"text-decoration: underline;\">property <\/span><\/strong><span style=\"text-decoration: underline;\">tax exemption<\/span>.<\/p>\n<p>(D) Other acts, occurrences, or events that indicate <strong><span style=\"text-decoration: underline;\">presence in<\/span><\/strong><\/p>\n<p><strong><span style=\"text-decoration: underline;\">the state<\/span><\/strong> is more than temporary or transient.\u00a0 [[ <strong><span style=\"text-decoration: underline;\">I do not remain on US property but only to pass.<\/span><\/strong> ]]<\/p>\n<p>(2) California<strong><span style=\"text-decoration: underline;\">residency is required<\/span><\/strong> of a person in order to be<\/p>\n<p>issued a commercial driver&#8217;s <strong><span style=\"text-decoration: underline;\">license<\/span><\/strong> under this code.<\/p>\n<p>(b) The presumption of residency in this state may be rebutted by<\/p>\n<p>satisfactory evidence that the licensee&#8217;s primary <strong><span style=\"text-decoration: underline;\">residence is in<\/span><\/strong><\/p>\n<p><strong><span style=\"text-decoration: underline;\">another state<\/span><\/strong>.\u00a0 [[ <strong><span style=\"text-decoration: underline;\">My <\/span><\/strong><strong><span style=\"text-decoration: underline;\"><a title=\"Kingdom License\" href=\"http:\/\/freeinhabitant.info\/travel-rights\/got-my-kingdom-driver-license.htm\" target=\"_blank\">Kingdom<\/a><\/span><\/strong><strong><span style=\"text-decoration: underline;\"> of <\/span><\/strong><strong><span style=\"text-decoration: underline;\">Heaven<\/span><\/strong><strong><span style=\"text-decoration: underline;\"> license is that evidence they chose to see<\/span><\/strong>. ]]<\/p>\n<p>(c) Any person entitled to an exemption under Section 12502,<\/p>\n<p>12503, or 12504 may operate a motor vehicle in this state for not to<\/p>\n<p>exceed 10 days from the date he or she establishes residence in this<\/p>\n<p>state, except that he or she shall obtain a license from the<\/p>\n<p>department upon becoming a resident before being <strong><span style=\"text-decoration: underline;\">employed for<\/span><\/strong><\/p>\n<p><strong><span style=\"text-decoration: underline;\">compensation<\/span><\/strong> by another for the purpose of driving a motor vehicle on<\/p>\n<p>the highways.<\/p>\n<p>(d) If the State ofCaliforniais decertified by the federal<\/p>\n<p>government and prohibited from issuing an initial, renewal, or<\/p>\n<p>upgraded commercial driver&#8217;s license pursuant to Section 384.405 of<\/p>\n<p>Title 49 of the Code of Federal Regulations, the following applies:<\/p>\n<p>(1) An existing commercial driver&#8217;s license issued pursuant to<\/p>\n<p>this code prior to the date that the state is notified of its<\/p>\n<p>decertification shall remain valid until its expiration date.<\/p>\n<p>(2) A person who is a resident of this state may obtain a<\/p>\n<p>nonresident commercial driver&#8217;s license from any state that elects to<\/p>\n<p>issue a <strong><span style=\"text-decoration: underline;\">nonresident commercial driver&#8217;s license<\/span><\/strong> and that complies<\/p>\n<p>with the testing and licensing standards contained in subparts F, G,<\/p>\n<p>and H of Part 383 of Title 49 of the Code of Federal Regulations.<\/p>\n<p>(3) For the purposes of this subdivision, a nonresident commercial<\/p>\n<p>driver&#8217;s license is a commercial driver&#8217;s license issued by a state<\/p>\n<p>to an individual domiciled in a foreign country or in <strong><span style=\"text-decoration: underline;\">another state<\/span><\/strong>.<\/p>\n<p>(e) Subject to Section 12504, a person over the age of 16 years<\/p>\n<p>who is a resident of a <strong><span style=\"text-decoration: underline;\">foreign jurisdiction<\/span><\/strong> other than a state,<\/p>\n<p>territory, or possession of theUnited States, the District of<\/p>\n<p>Columbia, theCommonwealthofPuerto Rico, orCanada, having a valid<\/p>\n<p>driver&#8217;s license issued to him or her by any other foreign<\/p>\n<p>jurisdiction having licensing standards deemed by the Department of<\/p>\n<p>Motor Vehicles equivalent to those of this state, may operate a motor<\/p>\n<p>vehicle in this state without obtaining a license from the<\/p>\n<p>department, <strong><span style=\"text-decoration: underline;\">except<\/span><\/strong> that he or she shall obtain a license before being<\/p>\n<p><strong><span style=\"text-decoration: underline;\">employed for compensation<\/span><\/strong> by another for the purpose of driving a<\/p>\n<p>motor vehicle on the highways.<\/p>\n<p>[[ <strong><span style=\"text-decoration: underline;\">I being an Article 4 \u201cfree inhabitant pursuant to the Articles of Confederation am \u201cforeign\u201d, or of a \u201cdifferent\u201d state (jurisdiction) than that of the <\/span><\/strong><strong><span style=\"text-decoration: underline;\">United States<\/span><\/strong><strong><span style=\"text-decoration: underline;\">.\u00a0 My jurisdiction is of <\/span><\/strong><strong><span style=\"text-decoration: underline;\">Church<\/span><\/strong><strong><span style=\"text-decoration: underline;\"> of <\/span><\/strong><strong><span style=\"text-decoration: underline;\">Jesus Christ<\/span><\/strong><strong><span style=\"text-decoration: underline;\">, which the <\/span><\/strong><strong><span style=\"text-decoration: underline;\">US<\/span><\/strong><strong><span style=\"text-decoration: underline;\"> fully acknowledges. <\/span><\/strong>]]<\/p>\n<p>(f) Any person from a <strong><span style=\"text-decoration: underline;\">foreign country<\/span><\/strong>, except a territory or<\/p>\n<p>possession of theUnited States, theCommonwealthofPuerto Rico, or<\/p>\n<p>Canada, shall obtain a class A or a class B license from the<\/p>\n<p>department before operating on the highways a motor vehicle for which<\/p>\n<p>a <strong><span style=\"text-decoration: underline;\">class A<\/span><\/strong> or <strong><span style=\"text-decoration: underline;\">class B<\/span><\/strong> [[<strong><span style=\"text-decoration: underline;\">see below *<\/span><\/strong>]] license is required, as described in Section<\/p>\n<p>12804.9. The medical examination form required for issuance of a<\/p>\n<p>class A or class B driver&#8217;s license shall be completed by a health<\/p>\n<p>care professional, as defined in paragraph (2) of subdivision (a) of<\/p>\n<p>Section 12804.9, who is licensed, certified, or registered to perform<\/p>\n<p>physical examinations in theUnited States of America. This<\/p>\n<p>subdivision does not apply to (1) drivers of schoolbuses operated in<\/p>\n<p>Californiaon a trip for educational purposes or (2) drivers of<\/p>\n<p>vehicles used to provide the services of a local public agency.<\/p>\n<p>(g) This section does not authorize the employment of a person in<\/p>\n<p>violation of Section 12515.<\/p>\n<p>(h) This section shall become operative on September 20, 2005.<\/p>\n<p>[[ <strong><span style=\"text-decoration: underline;\">Class A or B is not an issue for me because I do not operate in any location commercially, or as a resident.<\/span><\/strong> ]]<\/p>\n<p>&gt;&gt;&gt;<\/p>\n<p>&nbsp;<\/p>\n<p><strong><span style=\"text-decoration: underline;\">*<\/span><\/strong><\/p>\n<p>(1) <strong><span style=\"text-decoration: underline;\">Class A<\/span><\/strong> includes the following:<\/p>\n<p>(A) Except as provided in subparagraph (H) of paragraph (3), a combination of vehicles, if a vehicle <strong><span style=\"text-decoration: underline;\">being towed<\/span><\/strong> has a gross vehicle weight rating of more than 10,000 pounds.<\/p>\n<p>(B) A vehicle towing more than one vehicle.<\/p>\n<p>(C) A trailer bus.<\/p>\n<p>(D) The operation of all vehicles under class B and class C.<\/p>\n<p>(2) <strong><span style=\"text-decoration: underline;\">Class B<\/span><\/strong> includes the following:<\/p>\n<p>(A) Except as provided in subparagraph (H) of paragraph (3), a single vehicle with a gross vehicle weight rating of more than 26,000 pounds.<\/p>\n<p>(B) A single vehicle with three or more axles, except any three-axle vehicle weighing less than 6,000 pounds.<\/p>\n<p>(C) A bus except a trailer bus.<\/p>\n<p>(D) A farm labor vehicle.<\/p>\n<p>(E) A single vehicle with three or more axles or a gross vehicle weight rating of more than 26,000 pounds towing another vehicle with a gross vehicle weight rating of 10,000 pounds or less.<\/p>\n<p>(F) A house car over 40 feet in length, excluding safety devices and safety bumpers.<\/p>\n<p>(G) The operation of all vehicles covered under class C.<\/p>\n<p>Click <a title=\"INFO\" href=\"http:\/\/freeinhabitant.info\/?p=25\">HERE<\/a> to view the list of foundational information created by Lawyer Paul John Hansen to aid in independence from the US System.
