California\u00a0VEHICLE CODE<\/strong>\u00a0<\/strong>
\nSECTION 12500-12527<\/strong><\/p>\n

12505.\u00a0 (a) (1) For purposes of this division only and<\/p>\n

notwithstanding Section 516, residency shall be determined<\/span><\/strong> as a<\/p>\n

person’s state of domicile. “State of domicile” means the state where<\/p>\n

a person has his or her true, fixed, and permanent home and<\/p>\n

principal residence and to which he or she has manifested the<\/p>\n

intention of returning whenever he or she is absent.<\/p>\n

Prima facie evidence of residency for driver’s licensing purposes<\/p>\n

includes, but is not limited to, the following:<\/p>\n

(A) Address where registered to vote<\/span><\/strong>.\u00a0 [[ I am not a registered voter.]]<\/span><\/strong><\/p>\n

(B) Payment of resident tuition<\/span> at a public institution of higher<\/p>\n

education.<\/p>\n

(C) Filing a homeowner’s property <\/span><\/strong>tax exemption<\/span>.<\/p>\n

(D) Other acts, occurrences, or events that indicate presence in<\/span><\/strong><\/p>\n

the state<\/span><\/strong> is more than temporary or transient.\u00a0 [[ I do not remain on US property but only to pass.<\/span><\/strong> ]]<\/p>\n

(2) Californiaresidency is required<\/span><\/strong> of a person in order to be<\/p>\n

issued a commercial driver’s license<\/span><\/strong> under this code.<\/p>\n

(b) The presumption of residency in this state may be rebutted by<\/p>\n

satisfactory evidence that the licensee’s primary residence is in<\/span><\/strong><\/p>\n

another state<\/span><\/strong>.\u00a0 [[ My <\/span><\/strong>Kingdom<\/a><\/span><\/strong> of <\/span><\/strong>Heaven<\/span><\/strong> license is that evidence they chose to see<\/span><\/strong>. ]]<\/p>\n

(c) Any person entitled to an exemption under Section 12502,<\/p>\n

12503, or 12504 may operate a motor vehicle in this state for not to<\/p>\n

exceed 10 days from the date he or she establishes residence in this<\/p>\n

state, except that he or she shall obtain a license from the<\/p>\n

department upon becoming a resident before being employed for<\/span><\/strong><\/p>\n

compensation<\/span><\/strong> by another for the purpose of driving a motor vehicle on<\/p>\n

the highways.<\/p>\n

(d) If the State ofCaliforniais decertified by the federal<\/p>\n

government and prohibited from issuing an initial, renewal, or<\/p>\n

upgraded commercial driver’s license pursuant to Section 384.405 of<\/p>\n

Title 49 of the Code of Federal Regulations, the following applies:<\/p>\n

(1) An existing commercial driver’s license issued pursuant to<\/p>\n

this code prior to the date that the state is notified of its<\/p>\n

decertification shall remain valid until its expiration date.<\/p>\n

(2) A person who is a resident of this state may obtain a<\/p>\n

nonresident commercial driver’s license from any state that elects to<\/p>\n

issue a nonresident commercial driver’s license<\/span><\/strong> and that complies<\/p>\n

with the testing and licensing standards contained in subparts F, G,<\/p>\n

and H of Part 383 of Title 49 of the Code of Federal Regulations.<\/p>\n

(3) For the purposes of this subdivision, a nonresident commercial<\/p>\n

driver’s license is a commercial driver’s license issued by a state<\/p>\n

to an individual domiciled in a foreign country or in another state<\/span><\/strong>.<\/p>\n

(e) Subject to Section 12504, a person over the age of 16 years<\/p>\n

who is a resident of a foreign jurisdiction<\/span><\/strong> other than a state,<\/p>\n

territory, or possession of theUnited States, the District of<\/p>\n

Columbia, theCommonwealthofPuerto Rico, orCanada, having a valid<\/p>\n

driver’s license issued to him or her by any other foreign<\/p>\n

jurisdiction having licensing standards deemed by the Department of<\/p>\n

Motor Vehicles equivalent to those of this state, may operate a motor<\/p>\n

vehicle in this state without obtaining a license from the<\/p>\n

department, except<\/span><\/strong> that he or she shall obtain a license before being<\/p>\n

employed for compensation<\/span><\/strong> by another for the purpose of driving a<\/p>\n

motor vehicle on the highways.<\/p>\n

[[ I being an Article 4 \u201cfree inhabitant pursuant to the Articles of Confederation am \u201cforeign\u201d, or of a \u201cdifferent\u201d state (jurisdiction) than that of the <\/span><\/strong>United States<\/span><\/strong>.\u00a0 My jurisdiction is of <\/span><\/strong>Church<\/span><\/strong> of <\/span><\/strong>Jesus Christ<\/span><\/strong>, which the <\/span><\/strong>US<\/span><\/strong> fully acknowledges. <\/span><\/strong>]]<\/p>\n

(f) Any person from a foreign country<\/span><\/strong>, except a territory or<\/p>\n

possession of theUnited States, theCommonwealthofPuerto Rico, or<\/p>\n

Canada, shall obtain a class A or a class B license from the<\/p>\n

department before operating on the highways a motor vehicle for which<\/p>\n

a class A<\/span><\/strong> or class B<\/span><\/strong> [[see below *<\/span><\/strong>]] license is required, as described in Section<\/p>\n

12804.9. The medical examination form required for issuance of a<\/p>\n

class A or class B driver’s license shall be completed by a health<\/p>\n

care professional, as defined in paragraph (2) of subdivision (a) of<\/p>\n

Section 12804.9, who is licensed, certified, or registered to perform<\/p>\n

physical examinations in theUnited States of America. This<\/p>\n

subdivision does not apply to (1) drivers of schoolbuses operated in<\/p>\n

Californiaon a trip for educational purposes or (2) drivers of<\/p>\n

vehicles used to provide the services of a local public agency.<\/p>\n

(g) This section does not authorize the employment of a person in<\/p>\n

violation of Section 12515.<\/p>\n

(h) This section shall become operative on September 20, 2005.<\/p>\n

*<\/span><\/strong><\/p>\n

(1) Class A<\/span><\/strong> includes the following:<\/p>\n

(A) Except as provided in subparagraph (H) of paragraph (3), a combination of vehicles, if a vehicle being towed<\/span><\/strong> has a gross vehicle weight rating of more than 10,000 pounds.<\/p>\n

(B) A vehicle towing more than one vehicle.<\/p>\n

(C) A trailer bus.<\/p>\n

(D) The operation of all vehicles under class B and class C.<\/p>\n

(2) Class B<\/span><\/strong> includes the following:<\/p>\n

(A) Except as provided in subparagraph (H) of paragraph (3), a single vehicle with a gross vehicle weight rating of more than 26,000 pounds.<\/p>\n

(B) A single vehicle with three or more axles, except any three-axle vehicle weighing less than 6,000 pounds.<\/p>\n

(C) A bus except a trailer bus.<\/p>\n

(D) A farm labor vehicle.<\/p>\n

(E) A single vehicle with three or more axles or a gross vehicle weight rating of more than 26,000 pounds towing another vehicle with a gross vehicle weight rating of 10,000 pounds or less.<\/p>\n

(F) A house car over 40 feet in length, excluding safety devices and safety bumpers.<\/p>\n

(G) The operation of all vehicles covered under class C.<\/p>\n
